Defendant represented in its advertising that its toning footwear was effective in improving or increasing muscle tone, strength, and activation, that it was effective in improving overall circulation or aerobic conditioning, and that wearing the footwear would result in increased calorie burn, weight loss, loss of body fat, or improvement or reduction in body composition. Defendant is permanently enjoined from making any claims regarding its footwear's effectiveness in improving muscle strength, weight loss, or any other health or fitness-related claims unless such representations are non-misleading and non-deceptive and, at the time of making the representation, Defendant possesses and relies upon competent and reliable scientific evidence sufficient to substantiate that the representation is true. Consumer payments to be made pursuant to the Federal Trade Commission's Stipulated Final Judgment and Order. Defendant to pay $5,000,000.00 to the states participating in the multistate working group.
