Defendants offered debt adjusting services to consumers. Defendants committed unfair and deceptive acts in violation of the CSPA by: 1) advertising services that did not contain the characteristics advertised; 2) failing to perform services; 3) failing to provide promised refunds; 4) entering into consumer transactions while knowing of consumers' inability to obtain a substantial benefit; 5) requiring consumers to enter into contracts that were substantially one-sided in Defendants' favor; and 6) prohibiting consumers from contacting their mortgage servicers or lenders. Defendants violated the Debt Adjuster Act and the CSPA by engaging in debt adjusting activities without complying with the regulations set forth in the Debt Adjuster's Act. Defendants violated the TSSA and the CSPA by engaging in telephone solicitations without obtaining a certificate of registration as a telephone solicitor from the Ohio Attorney General's Office. Defendants violated the Credit Services Organization Act by operating as a credit services organization without being registered with the Division of Financial Institutions. Defendants to pay $338,484.00 in consumer restitution and $100,000.00 in civil penalties (suspended).
