Supplier agrees to refrain from: 1) publishing advertisements that notify consumers that they have won or are eligible to win a free prize, free trip, or something of value, or offering a free gift as an incentive for joining the vacation program, without disclosing all terms, conditions, and obligations upon which receipt and retention of the free goods or services are contingent; 2) advertising that consumers have won or are eligible to win a prize, trip, or something of value, without clearly and conspicuously disclosing any and all conditions necessary to receive the prize or thing of value, including that receipt of the prize is conditioned upon the consumer listening to a sales presentation or a presentation designed to market or sell goods or services to the consumer, or upon the payment of a service, handling, mailing, or other similar charge; 3) publishing advertisements that appear to have sponsorship, approval, performance characteristics, accessories, uses, or benefits that they do not have, including the appearance that the supplier is affiliated with certain major airline carriers or any other business not affiliated with Supplier; 4) publishing any advertisement that could lead a reasonable consumer to believe that the advertisement is from the United States Government. Supplier agrees to clearly and conspicuously disclose its name and business address on any and all advertisements. Supplier agrees to limit the time of sales presentations to the amount of time represented to consumers upon initial inquiry, excluding any additional time to which the consumer consents at the end of the initial presentation in order to respond to inquiries and/or to process or complete the sale. Supplier shall not require consumers to stay longer than the initial presentation as a condition to receive any promised incentive. Supplier agrees to present or make available to each and every consumer in the sales presentations for the vacation program a date-specific list of destination-based properties currently available for reservations through the vacation program during the succeeding 12 month period. Supplier to pay $25,000.00 for investigative and administrative costs.
